What do you know about current Canadian abortion law?

There is no right to an abortion in Canada. What exists is a lack of any law - for or against. In 1988, the Supreme Court of Canada wrote that parliament had right to create laws on abortion. In 1990, the Mulroney government attempted to pass such a law limiting abortions to situations in which the mother’s mental or physical health was threatened. The law passed the House of Commons, but was opposed in the Senate by various ideological camps, and died there. 

The Bottom Line:

There is no right to abortion enshrined in the Canadian Charter of Rights and Freedoms.


What other countries have similar abortion restrictions to Canada?

Canada, North Korea, and China, are the only countries on earth that allow for the killing of an unborn baby past the point of ‘fetal viability’ for any reason. This means that any pregnancy, up until the moment of birth, can be ended and the baby euthanized, even a day before the mother’s due date.


Is sex-selective abortion legal in Canada?

It is legal to abort unborn baby girls in Canada, for the ‘crime’ of being female. There is no law protecting unborn babies from being killed because of their sex. In 2021, Cathay Wagantall, a Member of Parliament from Saskatchewan, attempted to pass such a law, which would only have limited abortions based purely on the baby’s sex. 242 MPs voted against protecting baby girls in the womb, including our “feminist” Prime Minister, Justin Trudeau.

In 2012 the CBC reported that ultrasound technicians have been revealing the gender of babies in order to facilitate sex-selective abortions. Another study found that among Canadians of South Asian background who had prior abortions, 280 boys were born for every 100 girls in third live births. There was no uneven sex ratio for women who never had an abortion.


If abortion is banned, won’t there just be a bunch of kids languishing in foster care?

Polling data has shown time and time again that there are more Canadian couples looking to adopt, than children waiting to be adopted. What needs to improve is the bureaucratic red tape that makes more and more couples look overseas to adopt children. There is a growing demand for children to adopt in Canada, and we can help that process become easier for all involved by making one thing very clear: there are always, always, people waiting to adopt unwanted children. Choose adoption, not abortion.
